Under California law, the victim (or complaining witness) in any domestic violence case is entitled to have their own representative in court -- what is known as “Marsy’s Counsel.” In a domestic violence case, the state will be represented by the District Attorney, the defendant by the Public Defender or Private Counsel, and the victim by Marsy’s Counsel.
Marsy’s Counsel is present in court to assert the victim’s perspective. If the victim is eager for prosecution, this means advocating to the District Attorney and Court for aggressive prosecution and stiff punishment.
Often, however, the complaining witness in a domestic violence case will have change his or her mind about the entire case – and no longer wishes prosecution. In those cases, Marsy’s Counsel is also present in court to assert the victim’s perspective by lobbying the District Attorney and Court for leniency or even a dismissal of the entire case.
