California has a very progressive expungement statute, Penal Code Section 1203.4 This statute allows anyone convicted of a misdemeanor or a felony to have the conviction removed from their record for the purposes of most employment applications. Thus, if an expungement is granted, you can honestly answer "no" to any employment application which asks whether or not you have been convicted of crime. This can easily make the difference on a job application.
In order to be eligible for an expungement, you need only have completed probation without violating, or being sent to prison. In the event you were sent to prison, the case cannot be expunged. If your probation was violated at any time during your probation, the case may still be expunged, but the showing requirement to the court is more rigorous.
Call the office and Attorney Rhea will look up your case on the court computer, and tell you on the phone whether or not you are eligible for an expungement. If you are, it is a good idea to move forward. Expungements are not expensive and they clear your criminal record for most California employment purposes.
